This Waiver of Liability and Consent Form (the “Contract”) outlines the terms and conditions governing the use of party bus services provided by C’Mon Join the Joyride Bus (“the Company”). By signing this Contract, the undersigned individual (“Customer”) agrees to the following terms and conditions on behalf of themselves and all passengers attending the event under their booking.
1. Definitions
"Company" refers to C’Mon Join the Joyride Bus, its owners, employees, and agents. "Customer" means the individual booking the service and accepting responsibility for all guests. "Guests" refers to all individuals aboard the bus during the event.
2. Assumption of Risk
The Customer and all Guests acknowledge that the C’Mon Join the Joyride Bus is a moving vehicle without seatbelts, and passengers may stand or dance. All participants voluntarily assume all risks associated with the use of the bus, including but not limited to injury, accidents, collisions, injuries related to alcohol consumption, exposure to loud music, flashing lights, movement of the bus or other guests, or death.
3. Waiver and Release of Liability
The Customer and Guests agree to waive and release the Company from all liability, claims, or causes of action arising from use of the service, including property damage, personal injury, or legal consequences.
4. Alcohol and Substance Use
The Company complies with all Saskatchewan liquor regulations. Alcohol consumption is permitted only in accordance with applicable permits. Illegal substances or open commercial liquor are strictly prohibited unless properly licensed. This includes no alcohol will be provided to minors. Violations of this policy may result in immediate removal from the vehicle or full termination of services for the night without refund, at the Company’s discretion.
5. Smoking and Vaping
Smoking or vaping is prohibited on the bus as per The Tobacco and Vapour Products Control Act, except in designated areas if applicable. Violators may be removed from the vehicle. Repeated or serious violations may result in the immediate termination of the service for the remainder of the night without refund. Violations of this policy may result in immediate removal from the vehicle or full termination of services for the night without refund, at the Company’s discretion.
6. Conduct and/or Illegal Activity
The Company maintains a zero-tolerance policy toward lewd, disorderly, violent or illegal behavior (s). The Customer is responsible for ensuring that no Guests engage in any criminal, illicit, or inappropriate behavior, including drug use, underage drinking, prostitution, or criminal code or other legal offences. Violations could result in immediate termination of the service without refund. Violations of this policy may result in immediate removal from the vehicle or full termination of services for the night without refund, at the Company’s discretion.
7. Responsibility for Damages
The Customer assumes full responsibility for any damage to the bus caused by themselves or their Guests. This includes but is not limited to spills, breakage, rips, stains, bodily fluids, cigarette burns or destruction of equipment. Fees will be assessed for cleaning or repair and billed back for immediate payment. Violations of this policy may result in immediate removal from the vehicle or full termination of services for the night without refund, at the Company’s discretion.
In the event of non-payment or dispute, the Customer agrees to be liable for any legal fees, court costs, collections expenses, or other costs incurred by the Company in recovering the amounts owed.
8. Host Responsibility for Guests
The Customer acknowledges they are liable for the actions of all Guests. It is the Customer’s responsibility to ensure all Guests are informed of and comply with the terms outlined in this Contract.
9. Medical Emergencies
In the case of a medical emergency, the Company may seek professional assistance at its sole discretion. The Customer releases the Company from liability in such situations, including but not limited to injury, illness, overdose, or death occurring on or around the vehicle. The Company does not carry or administer Narcan (naloxone), EpiPens, or any form of emergency medical aid. It is not a medical service provider and does not guarantee the presence of medically trained personnel on board. If a situation appears urgent or life-threatening, the Company reserves the right — but assumes no obligation — to contact 911 or emergency services. Response times and medical outcomes are outside the Company’s control. By signing this waiver, the Customer acknowledges and accepts all medical risks associated with participating in this event and affirms that all Guests are aware of this policy.
10. Governing Law
This Contract shall be governed by the laws of the Province of Saskatchewan. All disputes shall be handled and resolved in the jurisdiction where the Company operates.
